COCOA CLASSIC 5K VOLUNTEER WAIVER This Assumption of Risk, Release of Liability, and Indemnification Agreement (“Agreement”) is entered into voluntarily by the undersigned participant (“Volunteer”) in consideration of being permitted to participate as a volunteer in the Cocoa Classic 5K (the “Event”). 1. ASSUMPTION OF RISK I acknowledge and understand that volunteering at a running event involves certain risks, including but not limited to: • Exposure to weather conditions such as heat, cold, rain, or wind; • Risks of falls, slips, or collisions; • Risks associated with handling event materials and equipment; • Physical exertion, dehydration, or exhaustion; • Interaction with participants, spectators, and other volunteers in a crowded environment; and • Any other foreseeable or unforeseeable hazards that may arise before, during, or after the Event. I voluntarily assume full responsibility for any risks of loss, damage, injury, or illness, including exposure to communicable diseases, that may occur as a result of my participation as a volunteer. 2. RELEASE OF LIABILITY I, on behalf of myself, my heirs, executors, administrators, assigns, and personal representatives, hereby release, waive, discharge, and hold harmless the following parties from any and all claims, liabilities, damages, or expenses (including attorney’s fees) arising out of or related to my participation in the Event: • Cocoa Classic 5K and its organizers; • The Mount Vernon School; • Event sponsors, vendors, and partners; • Any employees, agents, or representatives of the above entities; and • Any other volunteers, race participants, or spectators. I understand that this waiver applies to all claims, including those arising from the negligence of the released parties, but does not apply to claims resulting from gross negligence or intentional misconduct. 3. MEDICAL AUTHORIZATION In the event of a medical emergency, I authorize Event organizers and medical personnel to seek medical treatment on my behalf. I understand that I am solely responsible for any medical costs incurred as a result of my participation in the Event. 4. INDEMNIFICATION I agree to indemnify and hold harmless the released parties from any claims, damages, losses, or liabilities (including legal fees) that may arise due to my actions, conduct, or failure to comply with Event rules and instructions. 5. PHOTOGRAPHY & MEDIA RELEASE I grant permission to the Cocoa Classic 5K to use photographs, video recordings, or other media taken during the Event for promotional, marketing, or fundraising purposes without compensation or additional consent. 6. GENERAL AGREEMENT I certify that I am at least 18 years old, or if under 18, my parent/guardian has signed this Agreement on my behalf. I acknowledge that I have read and fully understand this Agreement, and by signing below, I agree to its terms voluntarily.
